Unfair Competition Law
The established knowledge of modern Law of unfair competition is one of the core competencies of BOEHMERT & BOEHMERT.
We advise our clients on unfair competition law disputes with competitors, trade associations, consumer associations or chambers of commerce. In some industries, we represent guilds in the pursuit of unfair competition. In addition, we accompany marketing and product campaigns for national and foreign companies and agencies from their inception onwards.
BOEHMERT & BOEHMERT’s team of attorneys is active across all areas of modern unfair competition law. Today, this includes:
- German Unfair Competition Act (UWG)
- Pricing regulations (PAngVO)
- Law on advertising in the health care system (HWG)
- Competition law regulations of the Foodstuffs and Commodities Act (LMBG)
- Other special regulations relating to the law on foodstuffs
- Foodstuffs marketing regulation
We advise heavily on unfair competition law disputes:
- We send and reply to out of court written warnings including the formulation of cease and desist declarations to be in the best interests of our client.
- We represent our clients in preliminary injunction proceedings.
- We submit protective letters to all relevant courts.
- We represent our clients in the main proceedings
- We offer advice in the hearing of evidence and substantiating evidence in particular in the form of opinion surveys.
- We represent our clients in sentencing proceedings in respect of infringement of court injunctions.
- We offer advice, management and staff training for the monitoring of the compliance with court injunctions and cease and desist declarations, in particular in larger corporations with a complex organisation structure.
In unfair competition law disputes, preliminary injunctions and warnings with a short notice period are standard practice. Consequently, it is often necessary to take on a client at short notice and process the case rapidly. We take on such a challenge with pleasure.
Of course we also advise out of court on matters of dispute avoidance (see campaign advice).
